JUDGE RULES IN FREELIFE’S FAVOR!</h1>
<p>United State District Judge David Campbell ruled AGAINST David Lucas<br />
Burge in his request to have FreeLife’s case against him dropped. In<br />
the Court Order, Judge Campbell made some very interesting and astute<br />
observations including (<a href="http://www.breatheexposed.com/court-order-on-breatheorg/court_order_on_jurisdiction_breathe/">See full court transcripts!</a>):</p>
<p>1.       Judge Campbell stated that Burge “argues that no valid<br />
contract was formed because he provided a false social security number<br />
and did not intend to become a FreeLife Marketing Executive”  <strong>Provides<br />
a false social security number.  (this may be, in and of itself, a criminal offense)</strong><br />
Yet one more lie to add to a resume filled with lies and distortions.</p>
<p>2.       Judge Campbell further stated that “An objective review of<br />
Burge’s actions can lead to only one conclusion – he agreed to the<br />
terms of Plaintiff’s contract. Burge cannot now use his hidden intent<br />
to negate his actions.”  What is Burge’s “hidden intent?” It appears<br />
to be profits and financial gain.</p>
<p>3.       Judge Campbell went on to say “indeed, the sole purpose of<br />
the website is to attack Plaintiff and Himalayan Goji Juice.”  Judge<br />
Campbell’s statement above is clear and direct. The sole purpose of<br />
the website” is to attack. Why would Burge attack? He sees a pot of<br />
gold at the end of the rainbow. <strong>By trying to put pressure on FreeLife,<br />
it appears Burge hopes to earn a huge financial settlement to take the<br />
website down.</strong> Our sources tell us that FreeLife<br />
will not cave into this tactic and will not pay Burge a single cent.<br />
They will bring him to justice.</p>
<p>4.       Judge Campbell then said, “What is more, Plaintiff has<br />
presented evidence that Burge attempted to hide his involvement with<br />
breathe.org and acted under the false name of Christian Truman – facts<br />
that could support a conclusion that Burge knew his actions were<br />
harmful to Plaintiff and tried to avoid responsibility for them.”  Yet<br />
more evidence about Burge’s lies. First, he tries to hide his<br />
involvement with breathe.org. Then he uses a false name on top of a<br />
false social security number. And then trying to “avoid<br />
responsibility” for his harmful actions. Are you beginning to see a<br />
pattern here? You cannot believe anything Burge says. <strong>He lies about<br />
his involvement in breathe.org, his name, his social security number!</strong></p>

<p>We’ve been made aware of a “Class Action” filed by Burge and a few<br />
others against FreeLife. We had a leading class action attorney take a<br />
look at the case and here is what we learned:</p>
<p>1.       <strong>The “class” has only 5 people in it and one has already<br />
dropped out!</strong>  The other included Burge (surprise!),<br />
someone from Australia and a FreeLife Marketing Executive who was<br />
terminated earlier this year for cross recruiting into another direct<br />
selling program. There is nothing “classy” about this class that you<br />
can count on the fingers of one hand!</p>
<p>2.       One of the plaintiff’s, David Wilson, sent a letter to<br />
FreeLife prior to joining the class action, which stated among other<br />
things:</p>
<blockquote><p>a.       “…David Burge, Lance Burge, and their lawyer, Gary D.<br />
Greenwald, have asked me to be a class representative in court as a<br />
main witness in their pending law suits. I told him I would think<br />
about it.”</p></blockquote>
<p>b.      Wilson then went on in the letter to request “compensation”<br />
from FreeLife (about $75,000) and <strong>“in exchange for this I will agree<br />
to a one year gag order on FreeLife dealings relative to </strong><a href="http://www.breathe.org"><strong>www.breathe.org</strong></a><strong>.</strong></p>
<p>c.       Wilson then goes on to say, “I would like to work this out<br />
amicably and quickly as I must let David Burge know what I am going to<br />
do.”</p>
<p>Our sources tell us that FreeLife flatly refused to make any payments<br />
to Wilson. Wilson then joined the class action and then quickly came<br />
to his senses and dropped out of the Class “less” Action.</p>
<p>BOTTOM LINE: This Class Action appears to be yet another futile<br />
attempt by Burge to profit from FreeLife’s ongoing success any way he<br />
can. Our attorney told us that he sees Class Actions filed all the<br />
time and that this case is one fo the weakest he has seen in many<br />
years.</p>

<p>For thousands of years, the goji berry (Lycium barbarum) has been a mainstay of Traditional Chinese Medicine (TCM), and its remarkable and diverse health-promoting properties have earned it a reputation as Asia’s most potent health food. Goji’s ancient tradition is now being confirmed by modern science, and dozens of published research papers have revealed that the goji berry’s broad-based health benefits are due primarily to the presence of unique molecules, not found in any other fruit, called Lycium barbarum polysaccharides (LBP). Unlike dried berries or any other goji product, FreeLife’s GoChi™ is standardized to an unprecedented potency of the all-important LBP.</p>
<p>In a recent clinical study, which was accepted for publication in the peer-reviewed Journal of Alternative and Complementary Medicine, participants who used GoChi experienced significant improvement in 13 key aspects of health and well-being in just 14 days.* The new antioxidant study discussed herein is yet another demonstration of the remarkable power of GoChi, and it illustrates FreeLife’s ongoing commitment to lead the nutrition industry in clinical research, product efficacy, and evidence-based product formulation.</p>
<h3><strong>REASONS FOR THE STUDY</strong></h3>
<p>From the earliest writings, the medical texts of Asia have declared the goji berry to be highly superior for maintaining the health and well-being of the entire body. The ancient herbalists had observed that those who used goji on a daily basis were healthier, more resistant to stress, and more resilient in their ability to recover from adversity. Today, scientists believe that these far-ranging traditionally observed benefits are directly related to the effects of goji’s unique bioactive polysaccharides (LBP) on the immune system, and this connection has been demonstrated in studies by numerous researchers. These investigations, however, have been performed primarily in cell culture and in animals. Although they may be predictive of the action of LBP in humans, they are not the equivalent of a controlled human trial. And so, this study was undertaken to scientifically investigate 4000 years of tradition by examining the effect of GoChi – a juice standardized to an exceptionally high potency of LBP – on three key serum markers of immunity. FreeLife® also sought to replicate the improvements in general well-being and neurological and psychological performance that were observed in its previous research.</p>
<h3><strong>STUDY DESIGN</strong></h3>
<p>This randomized, double-blind, and placebo-controlled 30-day clinical trial was conducted at a prestigious independent research institute in Asia and was designed to conform to the spirit of FDA Good Clinical Practice. Sixty healthy adult subjects were divided into two groups selected at random to ensure fair and even distribution of age, gender, health, and immune status between the two groups. The GoChi group was administered 120 ml (4 fl. oz.) daily of GoChi. The placebo group received the same daily dosing of an inactive placebo; a control solution that tasted, smelled, and looked like GoChi, but did not contain any goji juice or LBP. Neither the participants nor the scientists had any knowledge as to which group was drinking the GoChi and which was drinking the placebo. Furthermore, the participants and scientists had no affiliation with FreeLife, and had no familiarity with GoChi or Himalayan Goji® Juice prior to the start of the study.</p>
<p>Before beginning the study, all participants were given questionnaires to assess their starting point values for general well-being, and neurological and psychological performance. To determine starting point immune status, extensive physical exams were given, including blood chemistry, and urine and stool analysis. There were no significant differences between the two groups at the starting point, thus confirming suitability and compatibility. After the 30-day duration of the trial, complete workups were performed once again on all participants to determine statistically if there were any significant changes in each category between the start of the study and its completion. These tests found no abnormal changes in body weight, blood pressure, pulse rate, urine, stool, blood panel, and blood biochemistry in either group, and there were no adverse events reported by any subjects in either the GoChi or the placebo group during the study period, thus demonstrating the safety of GoChi.</p>
<h3><strong>RESULTS</strong></h3>

<p>After 30 days, the GoChi group showed statistically significant (p&lt;0.05) improvements in three key markers of immune health:<br />
First noted was a 27% increase in lymphocytes. These small white blood cells defend the body against bacteria, viruses, and toxins, and they also serve to command and direct many other immune functions.</p>
<p>Also found was a 58% increase in interleukin-2 (IL-2), a special cell messenger protein that alerts the immune system when danger is present. IL-2 also recruits stem cells for conversion into a wide range of T-cells, a vital part of the body’s targeted response to specific threats.<br />
Another important finding was a 19% increase in immunoglobulin G (IgG), a powerful and essential antibody that seeks out bacteria, viruses, molds, yeasts, and allergens, and then marks them for destruction by other divisions of the immune system.</p>
<p>Unlike the GoChi group, the placebo group experienced no meaningful change in immune status. When compared to the placebo group, the GoChi group also experienced far greater and statistically significant (p&lt;0.05) improvement in well-being, with a 63% total improvement in areas such as reduced fatigue and improved sleep quality, and with a tendency toward improved short-term memory and mental focus over the trial period. These findings were consistent with those shown in previous GoChi studies.</p>
<h3><strong>CONCLUSION</strong></h3>
<p>The results shown in this randomized, double-blind, placebo-controlled clinical study clearly indicate that daily consumption of GoChi for 30 days can significantly improve three key aspects of healthy immune function, and the study re-confirms previous findings that GoChi can improve general health and well-being with no observed toxicity or side effects.</p>

<p class="ja50-ce-simple-para">Although <em>Lycium barbarum</em> (goji) and active compounds, <em>Lycium barbarum</em> polysaccharides (LBP), have a high in vitro antioxidant score as determined by simple chemical reaction methods, their in vivo antioxidant effects in humans have not been extensively examined. After our earlier report that an LBP-standardized <em>Lycium barbarum</em> preparation (GoChi) helps prevent oxidant stress-related conditions in humans, our present study examined the hypothesis that the antioxidant effects of GoChi result from its ability to enhance endogenous antioxidant factors. We investigated the effects of GoChi in a 30-day randomized, double-blind, placebo-controlled clinical study. The study population included 50 Chinese healthy adults aged 55 to 72 years. In vivo antioxidant markers, consisting of serum levels of superoxide dismutase (SOD), glutathione peroxidase (GSH-Px), and lipid peroxidation (indicated by decreased levels of malondialdehyde, MDA) were examined preintervention and postintervention with GoChi or placebo (120 mL/d). In the GoChi group, antioxidant markers significantly increased by 8.4% for SOD and 9.9% for GSH-Px between the preintervention and postintervention measurements, whereas MDA were significantly decreased by 8.7%. In addition, the SOD, GSH-Px, and MDA levels in the GoChi group were significantly different from those in the placebo group at the postintervention time point, with increases of 8.1% and 9.0% and a decrease of 6.0%, respectively. No significant differences were detected between the preintervention and postintervention time points in the placebo group. These results indicate that GoChi increased antioxidant efficacies in humans by stimulating endogenous factors and suggest that continued use beyond 30 days might help prevent or reduce free radical-related conditions.</p>

<p><strong>Background:</strong> This randomized, double-blind, placebo-controlled clinical trial is the first study reported from outside China that has examined the general effects of the orally consumed goji berry, <em>Lycium barbarum</em>, as a standardized juice (<em>GoChi</em><sup>™</sup>; FreeLife International LLC, Phoenix, AZ) to healthy adults for 14 days.</p>
<p><strong>Methods:</strong> Based upon the medicinal properties of <em>Lycium barbarum</em> in traditional Asian medicine, we examined by questionnaire subjective ratings (0–5) of general feelings of well-being, neurologic/psychologic traits, gastrointestinal, musculoskeletal, and cardiovascular complaints as well as any adverse effects. Also, measures of body weight, body–mass index, blood pressure, pulse rate, and visual acuity were assessed before and after consuming 120 mL of <em>GoChi</em>/day or placebo control solution. Data were statistically analyzed for changes between day 1 and day 15.</p>
<p><strong>Results:</strong> Significant differences between day 1 and day 15 were found in the <em>GoChi</em> group (<em>N</em> = 16) in increased ratings for energy level, athletic performance, quality of sleep, ease of awakening, ability to focus on activities, mental acuity, calmness, and feelings of health, contentment, and happiness. <em>GoChi</em> also significantly reduced fatigue and stress, and improved regularity of gastrointestinal function. In contrast, the placebo group (<em>N</em> = 18) showed only two significant changes (heartburn and happiness). No significant changes in musculoskeletal or cardiovascular complaints were observed in either group. All parametric data (body weight, etc.) were not significantly different between groups or between day 1 and day 15 for either group.</p>
<p class="last"><strong>Conclusions:</strong> These results clearly indicate that daily consumption of <em>GoChi</em> for 14 days increases subjective feelings of general well-being, and improves neurologic/psychologic performance and gastrointestinal functions. The data strongly suggest that further research is indicated to confirm and extend knowledge of the potential effects of <em>Lycium barbarum</em> upon human health.</p>
