CLASS “LESS” ACTION

We’ve been made aware of a “Class Action” filed by Burge and a few
others against FreeLife. We had a leading class action attorney take a
look at the case and here is what we learned:

1.       The “class” has only 5 people in it and one has already
dropped out!
  The other included Burge (surprise!),
someone from Australia and a FreeLife Marketing Executive who was
terminated earlier this year for cross recruiting into another direct
selling program. There is nothing “classy” about this class that you
can count on the fingers of one hand!

2.       One of the plaintiff’s, David Wilson, sent a letter to
FreeLife prior to joining the class action, which stated among other
things:

a.       “…David Burge, Lance Burge, and their lawyer, Gary D.
Greenwald, have asked me to be a class representative in court as a
main witness in their pending law suits. I told him I would think
about it.”

b.      Wilson then went on in the letter to request “compensation”
from FreeLife (about $75,000) and “in exchange for this I will agree
to a one year gag order on FreeLife dealings relative to
www.breathe.org.

c.       Wilson then goes on to say, “I would like to work this out
amicably and quickly as I must let David Burge know what I am going to
do.”

Our sources tell us that FreeLife flatly refused to make any payments
to Wilson. Wilson then joined the class action and then quickly came
to his senses and dropped out of the Class “less” Action.

BOTTOM LINE: This Class Action appears to be yet another futile
attempt by Burge to profit from FreeLife’s ongoing success any way he
can. Our attorney told us that he sees Class Actions filed all the
time and that this case is one fo the weakest he has seen in many
years.

Chance of success?  Zero.
